The Cuomo court day will continue as the case is dismissed

“Because a complaint has been filed and he must be arraigned on it – the fact that the DA will join in the application/motion by his attorney to have the charge dismissed/and will decline to prosecute the case will be part of the proceeding,” Chalfen said in an email.

Cuomo, who resigned in August, was initially charged in November by Albany County Sheriff Craig Apple following allegations by former aide Brittany Commisso that he groped her at the Executive Mansion in 2020.

Soares this week announced that while he was “troubled by the allegations” there was not sufficient enough evidence to move forward with the case.  

Cuomo has denied the allegations.
